1. Definitions

  • "Olmara" / "We" / "Us" โ€” Olmara, operating from No. 296, Section 2, Daye Road, Yonghe District, New Taipei City 234, Taiwan.
  • "Service" โ€” in-home elderly care services offered by Olmara, including Hourly Drop-In Care, Health Tracking & Family Reports, and Dedicated Personal Caregiver arrangements.
  • "User" / "You" โ€” any individual accessing our website or entering into a care service arrangement with Olmara.
  • "Client" โ€” the senior individual who is the direct recipient of care services.
  • "Agreement" โ€” these Terms together with any written care plan or service letter exchanged with Olmara.

2. Acceptance of Terms

By using our website, submitting an enquiry, or entering into a care arrangement with Olmara, you confirm you have read and agreed to these Terms. You must be at least 18 years of age and have legal capacity to enter agreements. If acting on behalf of a client, you represent that you have appropriate authority to do so.

3. Description of Services

Olmara provides in-home personal care and support services for elderly individuals in Taiwan. Services are delivered by trained caregivers within the client's home environment and are described in detail on our website and in individual care plans.

Our services are non-medical personal care services. We do not provide medical treatment, nursing care, or any service requiring medical licensure. Where a client's needs exceed the appropriate scope of personal care, we will communicate this clearly to the family and assist in identifying suitable alternatives.

Service availability is subject to caregiver availability and geographic reach. We will advise promptly if we cannot accommodate your requirements.

4. User Responsibilities

In engaging Olmara's services, you agree to:

  • Provide accurate and complete information about the client's care needs, health context, and relevant personal circumstances
  • Inform Olmara promptly of any significant changes in the client's condition, household, or care requirements
  • Ensure the home environment is reasonably safe for caregivers throughout any service arrangement
  • Treat all Olmara caregivers and coordinators with courtesy and respect
  • Raise concerns through appropriate channels rather than directly reprimanding caregivers
  • Provide scheduling change notice as specified in your service agreement

Behaviour that is abusive, threatening, or discriminatory toward Olmara personnel may result in immediate termination of the care arrangement.

5. Intellectual Property

All content on this website โ€” including text, design, and structure โ€” is owned by Olmara or its content providers and protected under applicable intellectual property laws. You are granted a limited, non-exclusive right to access and read this content for personal, non-commercial purposes only. Reproduction, distribution, or commercial use without written permission is prohibited.

6. Payment Terms

All fees are stated in New Taiwan Dollars (NT$). Published pricing is confirmed in writing before any service commences. Payment terms, frequency, and accepted methods are detailed in each individual service agreement.

Olmara reserves the right to revise published rates with reasonable advance notice. Existing arrangements will be honoured at agreed rates for the current service period.

Cancellations: For Hourly Drop-In Care, visits cancelled with at least 24 hours' notice will not be charged. For other service tiers, cancellation and refund terms are set out in the individual service agreement.

7. Service-Specific Terms

Hourly Drop-In Care: At least 24 hours' scheduling notice is required per visit. Olmara will make reasonable efforts to provide a consistent caregiver but cannot guarantee this at all times.

Health Tracking & Family Reports: Reports reflect the caregiver's trained observations and are not medical assessments. Families should consult a qualified health professional regarding any clinical concerns that arise from report content.

Dedicated Personal Caregiver: Initial placement requires a matching process of up to five working days. Care plans are reviewed monthly and may be updated by mutual written agreement between Olmara and the family.

8. Disclaimers

Our services are provided with care and professionalism. However, we make no warranties that specific health, cognitive, or lifestyle outcomes will result from engaging our services. Outcomes are influenced by many factors outside Olmara's control.

9. Limitation of Liability

To the extent permitted by law in Taiwan, Olmara's liability for any claim arising from a service arrangement is limited to the total fees paid for the specific service in the three months preceding the claim.

Olmara is not liable for indirect, incidental, or consequential losses arising from the use of our services, except where such a limitation is prohibited by mandatory consumer protection law in Taiwan. All caregivers carry professional liability insurance providing additional protection.

You agree to indemnify and hold Olmara harmless from any claims or losses arising from inaccurate information you provided that materially affected the care arrangement.

10. Termination

Either party may end a care arrangement with written notice as specified in the service agreement (typically 7โ€“14 days depending on service type).

Olmara may terminate an arrangement immediately where a caregiver's safety is at risk, terms are materially breached, or the client's needs exceed the safe scope of personal care delivery.

All outstanding fees for services already delivered remain due upon termination by either party.

11. Dispute Resolution

These Terms are governed by the laws of Taiwan (Republic of China). Any dispute arising under them will first be addressed through good-faith discussion between both parties.

If informal resolution is unsuccessful within 30 days, disputes shall be referred to the jurisdiction of the competent courts of New Taipei City, Taiwan, unless mandatory consumer law requires otherwise.

12. General Provisions

These Terms, together with any written service agreement, form the complete understanding between you and Olmara. If any provision is found unenforceable, the remaining Terms continue in full effect. Our failure to exercise any right at any point does not constitute a waiver of that right. Rights and obligations under these Terms may not be assigned without Olmara's written consent.

13. Changes to Terms

We may update these Terms periodically. The date at the top of this page reflects the most recent revision. For changes materially affecting existing arrangements, we will notify affected clients directly. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
